Welcome to ByeCloud! These Terms of Service ("Terms") govern your use of our website (https://byecloud.xyz) and the ByeCloud application (collectively, the "Service"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Changes to Terms

We reserve the right to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

3. Use of the Service

You may use the Service only if you can form a binding contract with ByeCloud, and only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

You are responsible for any actions taken through the Service using your iCloud account or other credentials. If the Service requires or allows for the creation of a separate account or password, you are responsible for safeguarding that password. ByeCloud cannot and will not be liable for any loss or damage arising from your failure to comply with these security responsibilities.

4. User Data and iCloud

The ByeCloud application interacts with files stored in your iCloud to facilitate backup to your local storage and deletion from iCloud, based on your explicit actions. You retain full ownership of your files, data, and information (collectively, "User Data").

ByeCloud does not store, host, or claim any ownership of your User Data. Our Service solely acts as a tool to manage your User Data between your iCloud and your local storage, under your direction. These Terms do not grant us any rights to your User Data or intellectual property, except for the limited rights required to perform the actions you initiate through the Service (such as accessing iCloud with your permission to list, download, or delete files).

Any permissions you grant to ByeCloud to access your iCloud are solely for the purpose of providing the Service's functionality. ByeCloud is not responsible for the contents of your iCloud or your local backups.

5. Your Responsibilities

You are responsible for your conduct, the User Data you manage through the Service, and your communications with others while using the Services. You must comply with the following requirements when using the Services:

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

ByeCloud its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

8. Limitation of Liability

In no event shall ByeCloud, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
